Help understanding a federal tax lien

A federal tax lien can raise questions about property, financing, or a planned sale. The right discussion starts with the lien notice and the transaction or concern you need to address.

A lien and a levy are different

A federal tax lien is the government's legal claim against property for unpaid tax debt. A levy is an action that takes property. A public Notice of Federal Tax Lien informs creditors of the government's claim. Knowing which document you received helps identify the issue.

Use the right terms for your question

  • Release addresses the tax lien itself when the applicable requirements are met.
  • Discharge removes the lien from particular property under qualifying circumstances.
  • Subordination lets another creditor move ahead of the IRS in priority in qualifying cases.
  • Withdrawal removes the public notice; it does not by itself eliminate the tax debt.

Bring transaction details to the consultation

If a sale or financing decision is pending, tell us the anticipated date and which professionals are involved. Keep the tax notice, property description, and relevant correspondence together. An IRS request may require documentation and review; do not assume that a conversation or application immediately resolves the lien.

McNeel CPA can discuss the federal tax work involved and how it relates to your stated goal. William K. McNeel, EA, provides federal IRS representation nationwide after engagement and authorization. Legal title or transaction questions may require coordination with your attorney or closing professional.

Common questions

Does a tax lien mean the IRS has already taken my property?

A lien is a legal claim. A levy is an action that takes property. Bring the actual notice so the issue can be identified correctly.

Does withdrawal mean the tax debt disappears?

No. Withdrawal of the public notice is different from resolving the underlying debt.

Can you guarantee a lien issue will be resolved before closing?

No. The available route, documentation, and IRS review depend on the facts. Tell us about the closing date at the beginning of the conversation.
