IRS levy and wage garnishment help

A notice about a bank levy or wages needs prompt attention. Keep every page of the notice and identify any response or hearing deadline before putting it aside.

A notice deadline keeps running while you seek help. If a levy is active or a deadline is close, call 601-656-5568 and follow the notice instructions. A consultation request does not pause IRS action.

Identify whether the notice proposes action or reports an active levy

A levy can take property, including funds in a bank account or wages. A final notice of intent to levy and notice of hearing rights is different from an already active levy. The exact document, date, and account involved are important.

At the start of the call, tell us whether money has been taken or an employer or bank has contacted you. Explain the deadline printed on the notice and any immediate effect on essential living expenses.

Prepare a focused set of records

  • Keep the complete IRS notice, including enclosures and instructions.
  • Save any bank or employer correspondence about the levy.
  • Prepare an outline of income, essential expenses, and the immediate impact.
  • List previous IRS contacts, payments, or agreements related to the balance.

Evaluate the response based on the facts

The IRS describes circumstances in which a levy may be released, including certain economic-hardship situations. Whether release or another response is appropriate requires review. Resolving a levy and resolving the underlying tax balance are separate issues.

William K. McNeel, EA, can provide federal IRS representation after engagement and authorization. We can discuss the matter remotely with clients nationwide, but cannot promise a same-day release or a particular result.

Common questions

Does submitting your form stop a levy?

No. A consultation request does not stop IRS action or extend a deadline. Call if the matter is urgent and follow the instructions on the notice.

Can hardship be relevant?

Yes. The IRS describes economic hardship as a possible basis for levy release in qualifying circumstances. The facts and documentation matter, and release is not guaranteed.

If a levy is released, is the debt resolved?

Not necessarily. Levy release and the underlying tax balance are separate issues. The balance may still require an appropriate payment or resolution plan.
